According to a panel of Queensland law researchers, releasing the iPhone in Australia could be illegal under current Australian trade practices. What?! Basically, Apple’s carrier exclusivity deals with Australian wireless service providers could be seen as anti-competitive. Says law researcher Dale Clapperton, “The iPhone is breaking new ground in using technology to restrict customer’s choice in technology markets.” Although American customers have been forced to sign a two-year agreement with AT&T in order to purchase the iPhone, European lawsuits have softened Apple’s policies regarding iPhone availability- the iPhone is currently able to be used on any carrier in France. Seems like we got the short end of the stick here in America, eh? Mr. Clapperton also gave this fantastic analogy:
“It would be like Ford deciding that from now on all of the cars they produce can only use be used with petrol from Shell.”
